Can You Vacation While Receiving Workers’ Compensation?

As a result of being injured on the job you are currently receiving workers’ compensation benefits and recovering before being able to go back to work. While we know it’s okay to spend your day lying down and resting, is it okay to do so on a beach? Can you vacation while receiving workers’ compensation? Does doing so impact your ability to receive those benefits?

Treatment and Compliance

It’s not so much the vacation itself that could impact your ability to receive workers’ compensation benefits, as much as it is your failure to comply with your medical treatment. When part of your recovery process includes ongoing treatment, such as that of physical therapy, it’s extremely important that you comply with your plan by showing up for every appointment. Should you miss or cancel an appointment, your case manager may see you as non-compliant. And since most vacations would involve you missing an appointment, you would be taking a big chance of losing your benefits.

If you are planning a shorter vacation that will not interfere with your appointments and treatment plan, it could possibly be okay, but there are other things of which you should still be aware:

You may be watched by a hired investigator

It may sound a bit out there, but there’s a good chance that your employer’s workers’ compensation insurance company will hire an investigator to watch you. This is because the company doesn’t want to pay out if it doesn’t have to. This means you will have to be cautious of what you are participating in. And speaking of what you are participating in…

You may partake in things that go against your medical restrictions

Your doctor has likely given you specific restrictions in light of the limitations of your injury. Therefore participating in anything that goes against these restrictions can be very harmful, resulting in loss of your benefits. While this may not seem difficult to comply with, it can be extremely tempting when you are on vacation with others who are enjoying these activities. You may feel left out and want to join. Just keep in mind that a moment of enjoyment shouldn’t be worth your health and benefits.

Your social media will be closely monitored

Even if the hired investigator doesn’t watch your every move, sometimes social media can speak for itself. That’s why it’s so important that you refrain from posting pictures, statuses, or any content and ask your friends and family to do the same when it comes to you. This is because even something innocent can look guilty when only a snapshot is shown.

Dealing with a work injury can be extremely difficult, but dealing with it sans workers’ compensation benefits can be even harder. Don’t risk it. If you were injured at work and are now requesting workers’ compensation benefits, a knowledgeable workers’ compensation attorney can help. He or she has experience dealing with these types of cases and won’t let an insurance company deny you of the benefits to which you’re entitled.
